THE GIS DATA ARE PROVIDED TO YOU AS IS AND WITHOUT ANY WARRANTY AS TO THEIR PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR ANY PARTICULAR PURPOSE. The GIS Data were developed by the Western Pennsylvania Conservancy for its own internal business purposes. The Western Pennsylvania Conservancy does not represent or warrant that the GIS Data or the data documentation are error-free, complete, current, or accurate. You are responsible for any consequences resulting from your use of the GIS Data or your reliance on the limitations of the GIS Data and the precision with which the GIS Data may depict distance, direction, location, or other geographic features. If you transmit or provide the GIS Data (or any portion of it) to another user, the GIS Data must include a copy of this disclaimer.
The Western Pennsylvania Conservancy shall have no liability for any claim of infringement or rights by third parties based on any use of the Licensed Dataset in compination with programs, software, hardware, or equipment not designated by the WPC, without prior written approval by Western Pennsylvania Conservancy, if such infringement could have been avoided had the Licensed Dataset not been so used.
While Western Pennsylvania Conservancy warrants that the data in the Licensed Dataset has been reviewed to ensure compliance with quality control standards, WPC shall have no liability or responsibility to the data users, or any other person or entity with respect to any liability, loss, or damage caused or alleged to be caused directly or indirectly by the Licensed Dataset, including but not limited to any interruption of service, loss of business, anticipatory profits or indirect, special, or consequential damages resulting from the use or operation of the Licensed Dataset.
